For those who must be hearing about it all for the very first time, well, the City of St. Augustine is in a lawsuit against two property owners. And? Like, what really is the cause of the trouble? The city is in desperate need of constructing a seawall to manage the flooding that has been recurring for a long time in the area. The floods are such that streets get deluged and yards become waterlogged even after normal ​‍​‌‍​‍‌​‍​‌‍​‍‌storms.

And just so you know, in​‍​‌‍​‍‌​‍​‌‍​‍‌ order to construct the seawall properly, the city requires the ability to go through a thin strip of marshy land that runs along the back of five private properties by the lake. Among the five owners, three consented without any problem. But the other two refused to cooperate. So yes, as a result, the city had to file a lawsuit for eminent domain to continue its work. Basically, it has escalated to this ​‍​‌‍​‍‌​‍​‌‍​‍‌point.

The Flooding Issue That Never Seems To Stop

These​‍​‌‍​‍‌​‍​‌‍​‍‌ floods are not new or infrequent. You should know that they occur nearly every year, and sometimes several times a year. The area that is most affected is the neighborhood around Lake Maria Sanchez, which is located just south of downtown. A serious situation that is right there! Houses, streets, and even old buildings become the victims of the flood when there is a lot of ​‍​‌‍​‍‌​‍​‌‍​‍‌rain.

Overall,​‍​‌‍​‍‌​‍​‌‍​‍‌ the number of properties that have been impacted is upwards of 200, and among those, 186 are historic buildings. Hence, the city is not performing this action without any reason. Just saying! They are really attempting to preserve a whole district which, in spite of, is continually facing the identical ​‍​‌‍​‍‌​‍​‌‍​‍‌problem.

What’s The City Actually Planning To Build?

The​‍​‌‍​‍‌​‍​‌‍​‍‌ city is quite far along with a solid project plan on their part. Not a single doubt about that! And yes, this flood protection plan really took off and got a lot of attention after it was wrecked by Hurricane Mathew in ​‍​‌‍​‍‌​‍​‌‍​‍‌2016.

Here’s the breakdown of the plan:

  • Build a stormwater pump station at the south end of the lake
  • Upgrade drainage systems on Granada, Cordova, and Bridge Streets
  • Construct a seawall along the lake’s southern edge
  • Install one-way storm drain valves to let rainwater out and stop tidal water from pushing back in

Not to mention that, yes, the seawall is the most important part here since it’ll act as the main barrier to stop the flooding.

So, Why Did It All Lead To a Lawsuit?

Well, so far, we know that the​‍​‌‍​‍‌​‍​‌‍​‍‌ seawall has to be constructed right at the border of these five properties. While three owners consented to it, two refused even after the city attempted to negotiate with them. Therefore, the city filed a lawsuit for eminent domain on June 16, 2025. 

Let me explain it properly: eminent domain is the power that allows the government to take over private land for public use, but they are obliged to pay a fair price. And? What is so big of a problem? See, in this instance, however, the city is not taking any homes. They just require that little bit of land from the marsh, and the properties will still be private. The seawall will not be a public walkway or anything like ​‍​‌‍​‍‌​‍​‌‍​‍‌that.
